Rental Terms & Conditions


I hereby authorize Ward-Brodt Music and its agents to debit my account indicated within this agreement for the monthly lease fee hereunder, and to continue to do so until I return the instrument described within to Ward-Brodt Music at 5976 Executive Drive, Suite A, Fitchburg, WI 53719.

  1. MONTH TO MONTH RENTAL NOTICE:

    The undersigned hereby rents the instrument indicated within this agreement, on the terms and conditions of this agreement. The initial rental period shall end one month from the agreement start date stated within this agreement. The undersigned understands that rental payments do not apply toward any purchase.

  2. AUTOMATIC RENTAL AND MAINTENANCE PERIOD EXTENSION:

    If the instrument is not returned to Ward-Brodt Music, at the location listed above, on or before the last day of the initial rental period or any extension period, the customer shall be deemed to have exercised their option to extend the term of this rental for an additional one-month extension period. The customer will be debited for the monthly rental fee by Ward-Brodt Music on the first day of each extension period. There are no refunds for early returns.

CUSTOMER ACKNOWLEDGES RECEIPT OF AN EXACT AND COMPLETED COPY OF THIS AGREEMENT. THIS AGREEMENT INCLUDES ALL THE PROVISIONS ON THE REVERSE SIDE AS NOTICE TO THE CUSTOMER

  1. DO NOT SIGN THIS BEFORE YOU READ THE WRITING ON THE REVERSE SIDE, EVEN IF OTHERWISE ADVISED.
  2. DO NOT SIGN THIS IF IT CONTAINS ANY BLANK SPACES.
  3. YOU ARE ENTITLED TO AN EXACT COPY OF ANY AGREEMENT YOU SIGN.
  4. IT IS THE RESPONSIBILITY OF THE CUSTOMER TO NOTIFY WARD-BRODT MUSIC IF THEY WISH TO DISCONTINUE THEIR RENTAL.

  1. NONRENEWABLE OR DEFAULT:

    The customer may at any time during the rental term, return the instrument to Ward-Brodt Music without any further obligation, except to pay any rental fee which became due and payable prior to return of the instrument and except to pay any charge for repairs and reconditioning as provided in paragraph IV(d) hereof. For example, if the customer returns the instrument undamaged prior to the end of any rental term, the customer's obligations hereunder cease. Ward-Brodt Music may conclude this rental as of the end of any rental period by mailing written notice of non-renewal to the customer at the indicated address within this agreement, on or before the last day of the then current rental term. If the customer fails to pay the rental fee within 10 days after being due, Ward-Brodt Music may, at its option, terminate this rental and demand return of the instrument. If the instrument is not returned in accordance with the notice of non-renewal or demand, the customer shall be deemed in default, and in addition to any other amounts owing hereunder, shall be liable to Ward-Brodt Music for each calendar month (or part thereof) which elapses between the end of the rental period and the return of the instrument. If the instrument is not returned within 90 days following termination of the rental, the customer shall be liable to Ward-Brodt Music for the declared value of the instrument.

  2. ADDITIONAL TERMS AND CONDITIONS:
    1. During the existence of this Agreement, the customer will keep the instrument at the address with in this agreement, at the school, or other location where lessons are taken and such locations will not be changed without prior written consent of Ward-Brodt Music.
    2. The customer warrants that the musical instrument is to be used PRIMARILY for personal or family purposes.
    3. The customer shall not misuse, secrete, sell, encumber, remove or otherwise dispose of or lose possession of the instrument, nor permit nor suffer any lien, encumbrance or charge against the instrument. The loss, injury or destruction of the instrument shall not release the customer from liability for it. If the instrument is not returned to Ward-Brodt Music for any reason, the customer shall be liable to Ward-Brodt Music for the declared value of the instrument.
    4. If a returned instrument shows excessive wear or damage, including dents, bent keys, damaged valves or slides or excessive loss of bow hair or loss of strings by reason of abuse to the instrument, Ward-Brodt Music has the option to charge the customer and the customer shall pay an amount sufficient to cover necessary repairs and reconditioning.
    5. FORFEITURE CLAUSE:
      If the customer does not make payments as provided above and the instrument is left in a public place (i.e. not in your home), Ward-Brodt Music may legally take possession of the instrument.<
    6. Payments are due on or before the commencement of the initial rental period and each extension period.

  3. MAINTENANCE & REPAIR:

    Ward-Brodt Music shall, notwithstanding anything to the contrary contained herein, without additional charge and upon delivery of the instrument to its store at 5976 Executive Dr in Fitchburg, Wisconsin, provide all maintenance and repairs required to keep the instrument in good working condition, provided that the maintenance or repair is not resulting from misuse, abuse or neglect. Finish and lacquer is not included. In the case of fire or theft, your Homeowner's Insurance must pay Ward-Brodt Music the current replacement cost of the instrument minus your deductible. Ward-Brodt Music will pay only the amount of your deductible. Contact us after you have reported the loss to the proper authorities and your insurance agent. Exclusions: Any evidence of abuse, misuse, neglect or intentional damage will not be covered. With the exception of cases, strings and mouthpieces, this agreement does not cover accessories.

  4. The parties understand that the instrument rented hereunder is not a sale. Nor do any of the payments made go toward the purchase of an instrument.

  5. No provision of a marital property agreement, a unilateral statement electing to treat income to non-marital property as individual property or a court decree under the remedy provisions of the Marital Property Act adversely affects the interest of Ward-Brodt Music unless the Ward-Brodt Music, before granting rental, is furnished with a copy of the agreement, statement or decree or has actual knowledge of the adverse provision when the obligation to the Ward-Brodt Music is incurred.

CUSTOMER'S RIGHT TO CANCEL

You may cancel this agreement by mailing a written notice to Ward-Brodt Music Company, 5976 Executive Dr. Ste A, Fitchburg, WI 53719 before midnight of the third business day after you sign this agreement. If you wish you may use the lower copy as that notice by writing, "I hereby cancel" and adding your name and address. A duplicate of this statement is provided by Ward-Brodt Music for your records.
